What Information Do We Collect In Our Systems And How Do We Use
It?
The information we gather in our systems falls into two
categories: (1) personal information you supply, and (2) tracking
information collected as you navigate through web site.
Personally Identifiable
Information
We will collect personally identifiable information whenever you
do the following:
1. Purchase our products. When you purchase
products from us, we will collect personally identifiable
information about you such as your name, mailing address, e-mail
address, telephone number, and credit card number. We use this
information to process and communicate with you about your order.
When you purchase a product, you may also choose whether you want
us to send your information about our products, services, special
promotions or incentives.
2. Create an account. You have the option to
create an account with us on our web sites. When you create an
account, we collect personally identifiable information such as
your name, address, telephone number and email address. We use this
information to manage your account and customize and enhance your
online shopping experience. You may choose not to create an account
or not to provide us with certain information, but then you might
not be able to take advantage of many of the features on our
site.
If we wish to use your personal data for new purposes, we will
offer you the means to consent to those new purposes by: 1)
indicating at the point on the site where personal data is
collected; 2) contacting you by e-mail, phone or mail and asking
you to reply by sending an e-mail to harlan@harlan.com
or by visiting the site http://www.harlan.com/privacy_policy.hl.
Aggregate Information
When you use the web site, we may collect tracking information
such as your browser type, the type of operating system you use,
the domain name of your Internet service provider, and pages
visited on the site. None of this information identifies you
personally; we collect it for aggregate reporting on site activity.
For example, we may want to know how long the average user spends
on our site, or which pages or features get the most attention. We
use this information to make the site more useful to our customers.
We may share this information with our subsidiaries or other third
parties.
1. E-Mail. We use clear gifs in our HTML -
based e-mails that tell us whether or not you can accept HTML
images and, if you can accept HTML, whether or not you viewed the
e-mail. We use this information to help us make e-mails about our
products and services more useful and interesting. This process
does not leave any information on your computer, nor does it
collect information from your computer. We do not sell this
information to others, and we only use it to improve our e-mail
communications with you.
2. Cookies. A cookie is a block of text placed
in a file on your hard drive by a web site you’ve visited. We use
cookies to understand how our site visitors click to our site and
what pages they view during their visit. Cookies allow us to
personalize your shopping experience and speed the check out
process. We do not store any personal or financial information in
any cookie at any time.
We also use a session cookie, which is not placed on your hard
drive. A session cookie is a piece of identification between your
browser and our server that keeps track of the items in your
shopping cart and other session information. This cookie will
disappear when the session expires or when you close your
browser.
The “help” function on most browsers contains information on how to
set your browser to notify you before accepting cookies or to
disable cookies entirely. However, if you don’t accept cookies, you
won’t be able to take advantage of various features on our site
that are available to other visitors.
Privacy Principles
1. Notice. Where Harlan collects personal
information directly from individuals, it will inform them about
the type of personal information collected, the purposes for which
it collects and uses the personal information, and the types of
non-agent third parties to which Harlan discloses or may disclose
that information, and the choices and means, if any, Harlan offers
individuals for limiting the use and disclosure of their personal
information. Notice will be provided in clear and conspicuous
language when individuals are first asked to provide personal
information to Harlan, or as soon as practicable thereafter, and in
any event before Harlan uses or discloses the information for a
purpose other than that for which it was originally collected.
Where Harlan receives personal information from its subsidiaries,
affiliates or other entities, it will use and disclose that
information in accordance with the notices provided by those
entities and the choices made by the individuals to whom the
personal information relates.
2. Choice. Harlan will offer individuals the
opportunity to affirmatively consent (opt in) to the disclosure of
the personal information to a non-agent third party. For sensitive
personal information, Harlan will give individuals the opportunity
to affirmatively consent (opt in) to the use of the sensitive
personal information for a purpose other than the purpose for which
it was originally collected or subsequently authorized by the
individual, or to the disclosure of the information to a non-agent
third party. Harlan will provide individuals with a reasonable
mechanism to exercise their choices.
3. Data Integrity. Harlan will use personal
information only in ways that are compatible with the purposes for
which it was collected or subsequently authorized by the
individual. Harlan will take reasonable steps to ensure that
personal information is relevant to its intended use, accurate,
complete and current. The personal information you provide to
Harlan will be retained only for as long as necessary to fulfill
the purposes for which the information was collected or as required
by law.
4. Transfers to agents. Harlan may provide
information stored on the site and on its systems to agents for the
purposes listed in the following section “Do We Share The
Information We Receive?” Prior to sharing of your personal
information, an agreement is made between Harlan and the agent (to
whom we are transferring data). Under this agreement, the agent
will be held to equal privacy standards as Harlan. Where Harlan
becomes aware that an agent is using or disclosing personal
information in a manner contrary to this Privacy Policy, Harlan
will take reasonable steps to prevent or stop that use or
disclosure.
5. Security. Harlan will take reasonable
precautions to protect personal information in its possession from
loss, misuse, and unauthorized access, disclosure, alteration and
destruction. This includes, but is not limited to, the use of
encryption technology, regularly scheduled backups with sensitive
media secured in locked storage, and physical access limitations to
the servers and media that store personal information. Our
personnel who have access to personal information have been trained
to maintain the confidentiality of the information. Data
transmissions over the Internet cannot, however, be guaranteed to
be 100% secure. As a result, although we strive to protect your
personal information, we cannot guarantee or warrant the security
of any information you transmit to or from the site, and you do so
at your own risk.
6. Enforcement. Harlan will conduct compliance
audits of its relevant privacy practices to verify adherence to
this Privacy Policy. Any employee that Harlan determines is in
violation of this Privacy Policy will be subject to disciplinary
action up to and including termination of employment.
Do We Share the Information We
Receive?
We may share your information with third parties in the
following circumstances:
- Service Providers: We may employ third party
service providers to perform functions on our behalf. They have
access to personal information needed to perform their functions,
but may not use it for other purposes. Examples include fulfilling
orders, delivering packages, sending mail, analyzing data,
providing marketing assistance and processing credit card
payments.
- Protection of Harlan Laboratories and Others:
We may release personal information when we believe release is
appropriate to comply with the law; enforce or apply the Terms of
Use on this site and other agreements; or protect the rights,
property, or safety of Harlan Laboratories, our users, or others.
However, this does not include selling, sharing, or otherwise
disclosing personally identifiable information from customers for
commercial purposes in violation of the commitments set forth in
this Privacy Policy.
- Business Transfers: As we continue to develop
our business, we might sell or buy subsidiaries or business units.
In such transactions, customer information generally is one of the
transferred business assets but remains subject to the promises
made in any pre-existing Privacy Policy (unless, of course, the
customer consents otherwise). Also, in the unlikely event that
Harlan Laboratories, or substantially all of its assets are
acquired, customer information will be one of the transferred
assets.
- With Your Consent: Other than as set out
above, you will receive notice when information about you might be
shared with third parties, and you will have an opportunity to
choose not to share the information. For example, we might offer
you the opportunity to take advantage of a promotion that requires
us to share information with a third party. If you do not want your
information to be shared, you may choose not to provide the
information.
